Among the topics that will be discussed are recent cases involving (1) the scope of the government’s obligation to consider commercially available solutions; (2) challenges related to Other Transaction (OT) agreements; (3) the government’s justification for issuing a sole-source award based on an “urgent and compelling need,” and (4) the extent to which a contract modification may be set aside as anti-competitive and unlawful.
